Record of Decision

Decision Taken By: CABINET
Decision No: D110092CAB
Date: 22nd June 2011

Decision(s) and Reason(s)

Flexible Procurement of Utilities 2012 - 2016

Minutes

The report recommended that the Council enter a new four year flexible procurement agreement with LASER for the supply of electricity and gas for the period 1 October 2012 to 30 September 2016. It was noted that the recommendation was based on the financial savings under the current flexible procurement contract in place since 1 October 2008.
Since the Council had until 30 June 2011 to advise LASER of its commitment to enter the new four year framework agreement, the urgency provisions under Overview and Scrutiny Procedure Rule 15(i) were invoked so that the decision was not subject to call-in.

The Cabinet resolved that:
1) the Council enter the new flexible procurement agreement with LASER using the Purchase Within Period option for the supply of electricity and gas for the four year period 1 October 2012 to 30 September 2016; and
2) in accordance with Overview and Scrutiny Procedure Rule 15(i) and with the agreement of the Chairman of the Overview and Scrutiny Committee and the Leader of the Opposition, the normal call-in procedure be set aside to allow commitment to the LASER contract by the 30 June 2011 deadline.

Reasons: As set out in the report of the Central Services Director.

Signed Chief Executive: D Hughes

Date of Publication: 24 June 2011

This decision is not subject to call-in since in the opinion of the Cabinet it is urgent and any delay would seriously prejudice the Council's or the public's interest. (Overview and Scrutiny Procedure Rule 15(i)).
